Terms of use
These terms are an agreement between you and Ethan Thompson ("Ballwise", "we", "us"), who runs the Ballwise app, the website at playballwise.com, the Ballwise Ledger email and the @playballwise social accounts (together, the "Service"). By using the Service you agree to these terms and to our Privacy policy. If you don't agree, please don't use the Service.
The short version
- Ballwise publishes statistical model outputs about NFL games and player stats. It's for information and entertainment.
- We are not a sportsbook or a fantasy contest. We don't take bets or entries, and we hold no gambling license.
- Nothing here is a guarantee, or betting, financial or legal advice. Any decision you make with a third party is yours alone.
- You must be 21 or older and in the United States.
1. What Ballwise is
Ballwise shows numbers produced by a statistical model: projected game totals, the chance a player stays under a posted line, and a public record of the model's past picks, losses and voided picks included. These are estimates. Sports results are uncertain, and past results don't predict future ones. "Paper" picks are tracked for transparency and are not real wagers.
Ballwise doesn't accept, place or broker wagers or fantasy entries, doesn't link you to a sportsbook, and isn't paid by any sportsbook or fantasy operator.
2. Who can use it
You must be at least 21 years old and located in the United States. You're responsible for knowing whether sports wagering or paid fantasy contests are legal where you are, and for following those laws if you take part in them with anyone else.
3. Cost
The Service is free. There are no accounts, subscriptions or in-app purchases, and we never ask for a card. If that ever changes, we'll update these terms first, give at least 14 days' notice to the email list, and nobody will be charged without choosing a paid plan.
4. Third-party names and data
Ballwise is not affiliated with, endorsed by or sponsored by the NFL, the NFLPA, any team or player, PrizePicks, or any sportsbook. Their names are used only to describe which game, player or posted line a number refers to, and they belong to their owners.
Game and player statistics come from nflverse, licensed under CC-BY 4.0. Market prices and posted lines come from The Odds API. Data can be late, incomplete or wrong; check the source before relying on it.
5. Using the Service fairly
We grant you a personal, non-transferable, revocable permission to use the Service for your own non-commercial use. Please don't:
- resell or republish the Service's content as your own product, or present it as a guarantee;
- scrape it or pull it in bulk with automated tools beyond normal use of the app and site;
- interfere with the Service, try to break its security, or use it where that's against the law.
Sharing a screenshot or a link with friends is fine.
6. Ownership
The Ballwise name, football mark, design, text and model outputs belong to Ethan Thompson, except for the third-party data and names described above.
7. Play responsibly
If you choose to bet or play paid fantasy with anyone else, set a limit and only risk what you can afford to lose. If gambling is causing problems for you or someone you know, help is free and confidential: call or text 1-800-GAMBLER or visit ncpgambling.org.
8. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT ANY MODEL OUTPUT WILL BE CORRECT OR PROFITABLE, OR THAT THE SERVICE WILL BE AVAILABLE WITHOUT INTERRUPTION.
9. Limits on liability
TO THE FULLEST EXTENT THE LAW ALLOWS, Ethan Thompson WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY MONEY WAGERED, ENTERED OR LOST WITH ANY THIRD PARTY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO US$50. Some places don't allow some of these limits; where they don't, the limits apply as far as the law allows.
10. Your responsibility
If you misuse the Service or break these terms and someone brings a claim against us because of it, you agree to cover the reasonable costs of that claim.
11. The App Store
If you got the app from Apple's App Store, these terms are between you and Ethan Thompson, not Apple. Apple has no obligation to support or maintain the app and isn't responsible for it or for any claim about it, including product liability, legal compliance or intellectual-property claims. If the app fails to meet any warranty that applies by law, you can tell Apple and Apple will refund the price you paid, which is zero; beyond that Apple has no warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you aren't located in a country under a US government embargo and aren't on a US government list of prohibited or restricted parties.
12. Changes and ending
We may change or stop the Service, or update these terms. When we change these terms we update the date at the top of this page, and important changes are also announced to the email list. Using the Service after a change means you accept the new terms. You can stop using the Service at any time.
13. Law and disputes
These terms are governed by the laws of the State of Texas and applicable US federal law. Before filing any claim, please email us so we can try to fix it. Any dispute that isn't resolved goes to the state or federal courts located in Texas, except that either of us may bring a qualifying claim in small-claims court.
